Understanding the 2025 Changes to NSW Rental Laws
From 1 July 2025, NSW Fair Trading began collecting data on why tenancies have ended. Property owners and agents will now be required to submit this information when lodging or claiming a bond refund through Rental Bonds Online.
The platform has been updated with new mandatory fields to capture the reason a tenancy has ended. This is now a compulsory part of the bond process and no additional reporting will be required.

In an effort to better protect renter privacy, the Residential Tenancies (Protection of Personal Information) Amendment Bill 2025 was introduced into Parliament. The legislation aims to reduce the risk of data breaches and identity theft by:

Landlords and agents will need to adjust how they collect and store tenant information, using only what is legally necessary. Property tech platforms must also update their systems to comply with new data limits, transparency requirements, and privacy protections.
What Landlords Must Know About Ending a Tenancy
From 19 May 2025, landlords in NSW must cite a specific legal ground to terminate a tenancy. In some cases, supporting documentation is also required.
New Requirements for Renovation-Related Terminations
If a landlord intends to end a tenancy due to significant repairs or renovations, new rules apply from 20 June 2025. A landlord must now provide the tenant with a signed and dated written statement that:

Justifies why the property must be vacant

States the proposed start date for the works
No other documents are needed beyond this statement.
If a termination notice was issued between 19 May and 20 June, it must have included all the documents required at that time (i.e. a written statement and one additional prescribed document) in order to remain valid.
